nd Conditions (“Terms”) govern the use of Quote.Photography (the “Website”) and apply to both Users (individuals or businesses searching for photographers and videographers) and Members (photographers and videographers subscribing to a membership plan).

By accessing or using the Website, you agree to these Terms. If you do not agree, you must not use this Website.

1. Definitions

  • “Website” refers to Quote.Photography.
  • “User” refers to individuals or businesses using the Website to find and request quotes from photographers or videographers.
  • “Member” refers to photographers or videographers subscribing to a membership plan.
  • “Leads” refers to client requests for photography or videography services.
  • “Membership Term” refers to the duration of the Member’s subscription.
  • “We”, “Us”, “Our” refers to Quote.Photography.

2. Use of the Website

2.1 Website Access & Services

  • Users may use the Website to submit requests for photography and videography services and receive quotes from Members.
  • Members may use the Website to receive Leads and promote their services.
  • We do not guarantee that Users will book services with Members.
  • We do not act as an agent in transactions between Users and Members.

2.2 Acceptable Use

  • You must not use the Website for any unlawful purposes, including fraud, harassment, or misrepresentation.
  • Members must provide accurate information about their services, pricing, and availability.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

3. Membership Plans & Payment

3.1 Membership Plans

  • Members can subscribe to different membership tiers, which provide access to Leads and additional benefits.
  • Membership fees are payable annually in advance and are non-refundable.

3.2 Payment Terms

  • Payments are processed securely through our third-party payment provider.
  • Failure to make payment will result in immediate suspension or cancellation of the membership.

3.3 Membership Renewal & Cancellation

  • Memberships automatically renew at the end of the Membership Term unless cancelled in accordance with these Terms.
  • To cancel an automatic renewal, a Member must notify us via email to renew@quote.photography during the last 30 days of the Membership Term.
  • Cancellation requests sent before the last 30 days of the Membership Term will not be accepted.
  • Membership fees are non-refundable, and early cancellations will not result in a refund or partial refund.

4. Leads & Performance

4.1 Lead Distribution

  • Leads are matched based on the Member’s selected service categories and location.
  • Members must respond to Leads in a timely and professional manner.
  • We do not guarantee that Leads will convert into bookings.

4.2 Lead Quality

  • We take reasonable steps to verify Leads, but we are not responsible for the accuracy, completeness, or intent of client requests.
  • Members are responsible for conducting their own due diligence before engaging with clients.

5. Intellectual Property

  • All content on the Website, including logos, text, images, and software, is owned by or licensed to Quote.Photography.
  • You must not copy, reproduce, distribute, or modify any part of the Website without prior written consent.

6. Money-Back Guarantee

6.1 Eligibility for a Refund

We offer a Money-Back Guarantee to Members who do not receive any Leads during their Membership Term.

To qualify for a refund:

  • The Member must notify us via email at claim@quote.photography between the 9th and 10th month of their Membership Term if they have not received any Leads.
  • Claims cannot be made before or after this period.
  • If the Member has not received any Leads by the end of their Membership Term, a full refund of their Membership fee will be issued.
  • Failure to submit a claim within the required timeframe will result in ineligibility for a refund.

6.2 Refund Process

  • Once a refund claim is submitted, we will review and verify the Member’s account activity.
  • If eligible, the refund will be processed within 30 days to the original payment method.
  • Refunds do not apply in cases where the Member has received Leads but has not secured bookings.

7. Account Suspension & Termination

7.1 Member & User Violations

We reserve the right to suspend or terminate any account without notice if:

  • False or misleading information is provided.
  • Fraudulent or abusive activity is detected.
  • The Member fails to comply with these Terms.

7.2 Termination by Member

  • Members may cancel their subscription at any time; however, no refunds will be provided, except under the Money-Back Guarantee.

8. Limitation of Liability

  • Quote.Photography is not liable for any direct, indirect, incidental, or consequential damages arising from the use of the Website or Membership.
  • We are not responsible for disputes between Users and Members or for any losses resulting from unfulfilled bookings.
  • Our liability is limited to the membership fee paid by the Member.

9. Data Protection & Privacy

  • We comply with the UK General Data Protection Regulation (UK GDPR).
  • Personal data will only be used in accordance with our Privacy Policy.
  • Members agree that their contact details may be shared with Users submitting Lead requests.

10. Changes to These Terms

  • We reserve the right to update or modify these Terms at any time.
  • Members and Users will be notified of significant changes by email or a Website announcement.
